Terms of Service

1. The batteries and other equipment sold by The Simpler Times and Blue Sky Recycling Inc. is designed to be installed exclusively by licensed, trained, and insured electricians and electrical installation professionals. We strongly advise the Customer to seek the assistance of such a professional to perform the implementation of any of these products, and we make no warranty of the purchaser’s safety, the success of equipment implementation, or compliance with local codes and regulations. The Simpler Times disclaims all warranties, expressed or implied, including but not limited to, any implied warranty with respect to the accuracy or completeness of the information they disseminate and /or fitness of the materials sold for a particular purpose.

Some of the equipment sold may not include a manufacturer’s warranty. No warranty may be created or extended by sales or promotional materials on these items.

All installation advice provided by The Simpler Times before, during, or after the purchase of batteries or other equipment is purely for the purpose of general concept education and MUST NOT replace the expertise of a licensed and trained electrician or electrical specialist.

The Customer agrees to full indemnification for The Simpler Times henceforth from any legal recourse relating to and arising out of the installation of the products purchased by the Customer.

2. Full risk of loss and title passes to the Customer upon delivery of the merchandise to a carrier at the F.O.B. point. Claims for loss or damage in shipment must be made directly to the carrier. Upon Customer’s default in payment, seller may at its option repossess the merchandise. We will assist you in every way possible including calling the carrier to put a trace on the items you purchased, but we are not responsible for your product after it leaves our shipping location. It is up to you to get reimbursed from the freight carrier (Canada Post, UPS, Fed Ex, etc.).

3. Order cancellation: Customers may cancel any order before it has been processed. There is no fee for cancellation before the order has shipped. Cancellation requests after we have shipped and before customer has received product’s) will be charged freight and handling. The customer must then return the product freight pre-paid with the original packaging unopened to receive a full refund on the goods minus freight. Insuring goods is the customer’s responsibility. Any clearance items cannot be refunded or exchanged. Request for refund of non-defective and non-damaged goods after receipt will be charged a restocking fee of 10% or $30, whichever is less. After 14 days, all sales are final.

4. All products are sold with the manufacturer’s limited warranty, and if any such warranty exists it will be noted on the product sales page. If the merchandise happens to be damaged or defective upon receipt and it was not the shipper’s fault, we will replace it. We must be notified of defect within 72 hours of receipt. Defective items will be replaced with the same or comparable item. Returns for refund that are not damaged or defective will be charged a 10% restocking fee or $30, whichever is less, and must be returned within 14 days in new and re-saleable condition with all manufacturer’s boxes, brochures, and warranty cards, and paperwork in perfect condition. Shipping & Handling in such cases is not refundable. Shipments back to us must be paid and insured by the buyer under all such circumstances. Shipments from us to the buyer will be paid by us via UPS Ground, Fedex, or Canada Post (regardless of how the initial order was shipped eg. Overnight, 2nd Day, etc.., we will ship regular surface) under circumstances where the items were received initially defective. Cross-shipments of merchandise is available only for extraordinary circumstances. For replacement items due to size or fitting, customer must pay freight both ways.

5. Suggested Replacement Items for previously discontinued or out of stock goods are not guaranteed to encompass all the features and value points of the previous good. The customer must do their own research to ensure that they are buying what they need or want. We will do our best to help you obtain the correct item, but ultimately, the responsibility is the Customer’s.

6. We do not guarantee delivery. Delivery guarantees are assumed by the shipping company. We can only ship via your request. We do not take responsibility for late shipments due to a delivery error or errors by shipping companies. There are no refunds due to errors of this nature. We usually ship within 5 working days.

7. Any dispute or legal action from any transactions with The Simpler Times will be processed within the jurisdiction of the Hastings County court system of Ontario, Canada.

8. To request a return or exchange, please call us at 705-313-4769, or email [email protected]. All returns must be in their original shipping package or something comparable. Do not ship anything back solely in the original manufacturer’s box or packaging. This may void our ability to exchange your product or give you a refund/ credit. Do not ship anything back before contacting us.

9. Credit card orders may be processed before the items ship. We will do our best to inform you if your product is late.
